Peter Martin has failed in a £1.2m claim against STV for ditching his football talk show.

Hosting alongside Alan Rough, Martin had a steady pool of pundits to discuss the burning issues in Scottish football with regular guests including Gordon Strachan, Martin O’Neill and Neil Lennon.

After 19 shows of a 38 show contract STV called time up during the 2018/19 season with PLZ which switched to You Tube.

Despite big name guests each show only attracts around 10,000 views on You Tube with PLZ also producing regular updates and news throughout the day.

STV compensated Martin for the remainder of the contract but the former Radio Clyde presenter believed that he lost out on the opportunity of taking the show onto another mainstream broadcaster.

The Sun reports:

PLZ wanted £135,379 for the remaining shows under the contract with STV and also claimed £1,086,382 for damages after alleging the cancellation denied them the chance to market the show to another broadcaster.

STV denied the claims and said PLZ had provided ‘no specification’ of alleged costs and ‘impossible’ to calculate alleged losses.

Sheriff Stuart Reid rejected the bid by PLZ to sue the broadcaster.

In a ruling, he said: “In my judgment, looking at the contract as a whole, it is, in essence, an agreement whereby the pursuer undertook to provide certain services to STV, and STV undertook to pay the agreed price for those services. It is not much more complicated than that.”

The sheriff added: “While it is undoubtedly correct that both parties envisaged that the Friday the Show would be broadcast, it cannot be said, on an objective assessment, that transmission of the footage is necessary to give the contract business efficacy.

“PLZ might well be disappointed that the fruits of its labour are not broadcast to the nation; STV might be equally disappointed but the contract ‘works’ perfectly well as a mechanism by which STV acquires a finished product, or ‘content’ to use the media terminology, that is capable of being broadcast, should it choose to do so.

“For the foregoing reasons, I have sustained the defender’s preliminary plea and dismissed the action.”

PLZ Soccer Ltd and STV were both approached for comment.
