SPL Celtic newsHibs have become the third SPL club to announce that they will vote no to the newco application to join the SPL.

Following on from last week’s decisions from Hearts and Dundee United the Edinburgh side made an announcement tonight on the club website.

It read: “Following a meeting of its Board of Directors, Hibernian FC confirmed that the Club will vote against the transfer of the Rangers share in the SPL to a newco at the General Meeting of SPL clubs on 4 July 2012.

“This re-affirms the view of the Board that the sporting integrity of the SPL is of paramount importance.

“The Board is also acutely aware that in making this decision, Hibernian –  like other clubs in the SPL – will suffer collateral financial damage at a time of severe economic hardship and uncertainty.

The Board believes it is time for all fair minded supporters to get behind their clubs and to contribute in whatever way they can to the viability of the professional game in Scotland.”

News of the Hibs vote is another massive blow to Charlie Green’s hopes of getting his Sevco club admitted into the SPL to replace Rangers.

Neil Doncaster will host a meeting of SPL clubs at Hampden tomorrow knowing that there is virtually no chance of mustering the eight votes required to allow Sevco into the top division.

Sevco need to find eight votes to get admitted to the SPL but no club has yet declared that they will vote yes although Kilmarnock chairman Michael Johnston has gone into detail about the need to have a Rangers club in the SPL.

Yesterday a joint statement between the SPL, SFA and SFL confirmed that talks are on-going to merge the two leagues together under the direction of the SPL.

With just five weeks to go till the opening of the SFL season with the Ramsden’s Cup Sevco face a race against time if they wish to apply for a place in the SFL with the SPL almost certain to promote Dunfermline or Dundee to take the place of Club 12 in next season’s fixture list.

    When all the wheeling and dealing was being done behind closed Ibrox doors with Sir Tainted Murray and Craig Whyte this case scenario was never imagined.

    They had obviously banked on being such a big club that they could never be put out of the SPL. Well, that is what is about to happen and the proverbial has hit the fan.

    Seems like Sporting Integrity is still alive in Scotland after all much to the annoyance of Reagan and Doncaster who have prostrated themselves at the feet of dead Rangers and Sevco to keep the ‘brother’s’ happy.

    Their actions will not be forgotten.

    Don’t count the chickens yet guys. I can’t help but feelwe are going to get screwed yet. So far, three say no, we haven’t said anything, but we still only make four. That leaves a possible eight for “yes”
    Something fishy is going on behind closed doors here, I still don’t like it.

    The old Rangers FC have been liquidated because they failed to pay their debts. It is illegal to resurrect a business that mirrors the old business in any shape or form.

    Regarding a new professional Scottish football team from the ashes of the old team, the use of the name “rangers” can not be used for a five year period. The law restricts the re-use of a name previously used by a company that has gone into insolvent liquidation (section 216 of The Insolvency Act 1986). This restriction applies personally to a director of the company in insolvent liquidation.

    The directors of the old Rangers FC will be investigated and could face harsh penalties including jail time.

    When a company goes into liquidation the directors no longer have any control over it and the liquidator takes over.

    The directors still have a duty to co-operate with the liquidator and must identify all assets and liabilities of the company and provide details of its affairs. The liquidator has to make a return under the Company Directors’ Disqualification Act 1986 about the directors’ conduct in relation to the company.

    If the SPL treat the “newco” as if it were the fallout of the old liquidated Rangers FC company, then the SPL administrators will be compliant in a criminal conspiracy.
