Whittaker: No loyalty to the new club

Steven Whittaker Rangers newsSteven Whittaker has cast doubts over Charlie Green’s newco Sevco as the Yorkshire businessman braces himself for more players refusing to transfer their contracts.

Alongside Steven Naismith the former Hibs defender was on the verge of tears as he explained his reasons for moving on.

Green has threatened legal action against any club that signs up any former Rangers players and has called in the SFA to block any transfers.

The SFA are obliged to issue an International Transfer Certificate for any moves outwith Scotland with both Whittaker and Naismith expected to move to England.

Since Rangers moved into liquidation there has been confusion over the relationship between the old club and the newco but Whittaker sees things being clear cut.

“I think that it’s important that we express the loyalty that was shown to the club,” he explained. “Through the hard times of administration, the 75% wage cuts that we took, we didn’t need to do that.

“We gave the club the opportunity to try and get through the CVA and continue but obviously that outcome didn’t turn out the way we wanted it to.

“The new company has only started, there’s no history there for us so we owe no loyalty to the new club.”

He added: “From a football point of view I feel that it’s best to continue my career elsewhere. Going by the punishment coming to the club it doesn’t look like they’ll be playing in the SPL or any European football.

“I’m 28 and want to play at the top level as much as I can and it doesn’t look like that I’m going to get that opportunity here.”

When this scenario was first mooted, what was being said was, that when a club goes into liquidation, all players contracts to that club pass into the hands of the SFA.
Although the SFA don’t make any money from the transfer of the players contract to another club, other than administration costs, why is it taking so long for these matters being passed on to the liquidators and why are D&P, considering their record so far and the fact they are now subject to a criminal investigation, still being allowed to run roughshod over every rule in the game?
And why is this chancer Green who, as far as I can see, has done nothing for the game in Scotland but loan a NEW COMPANY a few quid,(it’s yet to be seen if there will actually be a football team), being allowed to threaten the SFA, SPL, football managers, football players, football clubs and shout the odds in Scotland telling everyone, who will listen, how it’s going to be and how the rules and laws of the game ARE NOW going to be applied?????
    I SMELL DAVID MURRAY!!!!

I’m probably just a paranoid Celtic supporter, and there’s a good possibility that after four months of the Govan X-files I’m just losing it. However, I can’t help feeling that the fiascos with the Duffs, Miller, and now, Mr Charlie Green are just a side show. There must be something bigger going on.

I smell a lot of desperate villans in high places still trying to cover up what could be the biggest scandal ever in world sport. Will we ever find out just how many people ‘benefitted’ from Murray’s EBT scheme? Or who their actual employers were?

The truth is probably out there, but some people don’t want anyone finding it, ever.

To pick up on the point made by Maxx, Celticfcblog on KDS posted the rules relating to liquidated clubs the other day.

As I understood it upon liquidation the registration should revert to the SFA who would then have the ability to sell the player to anyone who wants to buy him provided of course the player wants to go. Any money received in this way would go into the creditor pot.

I interpreted that as meaning that Sevco would have no more right to the registration than any other club

I think part of the problem may be that SFA rules and employment law are not consistent. So if the SFA were to try to get a transfer fee the player could simply ignore this and go to another club who paid him directly rather than the SFA

As ever the SFA look like a shower of bumbling incompetents

Not too surprising given that Ogilvie and Regan are the current top men and their immediate predecessors were Smith and Peat.

    • MaxX says:

I’m interested in what you’re saying SJY, it was my understanding of the rules that players of a liquidated club were free agents and that was why the contracts were moved to the SFA.
Basically, the SFA take their money for admin and for the rest, they are all free agents, able to negotiate there own transfer, and the proceeds very much their own to deal with, and to do with as they want.

      • MaxX says:

        SJY?

        • SJY says:

Sorry Maxx, not entirely sure of my ground on this one but I think what cfcblog was saying was that the registration reverted to the SFA. So to that extent they can’t move unless the association sanctions the move. However the position in employment law is that if you refuse a TUPE transfer you are free to move as you see fit.

As ever where there is a conflict between civil law and football regulations it’s unlikely that football regulations will prevail. To a certain extent that was the lesson of the Bosman ruling

        • MaxX says:

The point is m8, that there is no transfer money, they’re free agents and basically on a free transfer.
          Am I wrong?

        • MaxX says:

This is no a dig m8, it’s a complicated affair to start with without the obfuscation and the muddying of the waters the currents are attempting!!

  • dombhoy67 says:

Sevco 5088’s team line up for next season’s Third Division is:
    Goalkeeper: Charlie Green
Back Four: Duff, Phelps, Hugh Keevins, Wattie Smith.
Midfield: Broxie Bear, Craigie Whyte, Jim Traynor, John Greig.
    Strikers:Fat Sally, Chick Young.
Subs: Brian Kennedy, Ibrox Lavvie cleaner, Lee McCulloc.
Look out Third Division the Sevco Dodo’s are on their way to a park near you.

  • Tully says:

Green was spouting that the then rangers would achieve a CVA and if that had happened these players would have stayed while they came out of administration and then have been sold at a discounted price which they agreed with Green.

Well Mr Green, no CVA = no player agreement as the horrible bigoted club is dead!

FFS, if he can’t figure that out then I can’t wait to hear him eat humble pie following his meeting with bawbag Wishart.
